Before we can determine who is at fault, let’s take a look at a slightly different question.

What Is Fault?

Fault falls on the driver who was either reckless or negligent. Reckless driving is defined as the willful or wanton disregard for the safety of others or the operation of the vehicle. Negligence can often be a difficult area of law to define because it involves a legal analysis of the elements as they relate to the facts of a particular case. Typically, a negligent driver was ‘careless’. 

Determining which driver is at fault in a multi-car accident is important because it establishes who is responsible for payment of the damages.  Damages may include medical expenses, lost wages, and  property damage.
